Terms and Conditions

1. Cake Design

​

1.1 All cake designs remain the intellectual property of Bridal Select Cakes (BSC). Most cakes will be used in promotional material on Facebook, Instagram and the BSC website.

1.2 Although every attempt will be made to meet the sketch and design brief, there may be circumstances in which BSC needs to alter the design to achieve the overall desired effect. This may be due to circumstances outside of BSC control including factors such as hugh humidity, availability of flowers etc

1.3 Flower placement may need to be changed to suit the size of the flowers etc.

1.4 Any major changes will be directed to the client for approval.

1.5 BSC may use photos of your cake in social media, website and print advertising and reserves the right not to seek permission to do so.

 

2. Payment

2.1 A minimum booking fee of $150 (of which $150 is non-refundable) is due within two weeks of notifying BSC to go ahead if you are unsure of design but would like to book. The balance of your order will be due on or before four weeks prior to the date of your wedding.

2.2 Payment will be accepted via direct deposit or credit card. 

 

3. Change of Design

3.1 All orders with a booking fee paid are considered confirmed designs. Any major changes to the order, including, changing the entire cake design, will need to be made at least one month before the wedding. Please note, some changes may not be able to be accommodated, due to the complexity of the design and/or the volume of other orders. Please note that changes to orders may not always be accommodated.

 

4. Secondary Consultations

4.1 All orders are inclusive of an initial consultation at no cost. If you would like to have a second consultation, there will be an additional fee of $50 added to your invoice. All communication via email after and before bookings are at no cost.

 

5. Confirmation Emails

​

5.1 BSC will send you a confirmation email six weeks before your wedding. Please ensure that you read this email and respond within seven days. No major changes can be made after this date.

 

6. Allergies

 

6.1 BSC takes no responsibility for any guest allergies. Ingredients (including flour, chocolate etc) are produced by suppliers and therefore, BSC cannot take responsibility for any production of individual ingredients.

 

7. Cancellation

7.1 Orders are not confirmed until a booking fee of $150 is paid. Cancellation before this will not incur a fee.

7.2 Cancellation at any time after booking fee has been paid will forfeit a $150 administration fee.

7.3 Cancellation after the final balance has been paid with less than 30 day prior to wedding will forfeit the booking fee and 50% of the total cake cost as this date is unlikely to be re-booked, supplies will have been ordered. 

7.4 Cancellation with less than 7 days notice will forfeit 100% of the cake cost.

7.5 Postponement - should you need to postpone your wedding, notice must be made within 4 weeks of the original wedding date. All postponements must have a minimum 50% of the total invoice amount paid, which will be non refundable should the postponed date be cancelled. Postponements are possible for 12 months from the date of the original wedding date. Should you wish to postpone beyond 12 months of the original wedding date, the cake may be subject to a review for price increases and the invoice amended accordingly. There is no guarantee of availability for the new date as this date may be unavailable due to other orders. Postponements which can not be accommodated will be treated as per the conditions for a cancellation.

7.6 Force Majeure - In the event that either party is prevented from performing or is unable to perform any of its obligations under this Agreement (other than a payment obligation) due to any act of God, acts or decrees of governmental or military bodies, fire, casualty, flood, earthquake, war, strike, lockout, epidemic, pandemic, destruction of production facilities, riot, insurrection, or any other cause beyond the reasonable control of the party invoking this section (collectively, a “Force Majeure”), and if such party shall have used its commercially reasonable efforts to mitigate its effects, such party shall give prompt written notice to the other party, its performance shall be excused, and the time for the performance shall be extended for the period of delay or inability to perform due to such occurrences. Regardless of the excuse of Force Majeure, if such party is not able to perform within 365 days after such event, the other party may terminate the Agreement and the standard cancellation policy will apply.

 

8. Refunds

8.1 Refunds will only be paid in instances where damage has occurred by BSC.

8.2 BSC is not liable for the cake after delivery. Venues often move cakes etc after delivery and this renders the warranty void. Should the venue move the cake or insist on placement in the venue which is detrimental to the cake, BSC will not be liable.

8.3 Any refund will require photographic evidence and a sample of cake will be returned to BSC within 24 hours of the event date.

8.4 There will not be refunds for customers who no longer like the particular flavour they have chosen.
